Terms of service

These terms govern your use of perpetuaforma.com and any purchases or submissions you make through it. By creating an account, placing an order, or submitting work, you agree to them. Read them carefully; they include important information about your rights and ours.
1. Definitions
- Perpetua Forma, we, us — Perpetua Forma, Binckhorstlaan 36, Unit M3 12, 2516 BE The Hague, The Netherlands. KvK 83241590. VAT NL003791144B12.
- Customer, you — the individual or organisation entering into an agreement with us, whether by creating an account, placing an order, or submitting work.
- Consumer — a Customer who is a natural person acting outside of a profession or business.
- Products — the furniture, objects, printed Issues, and any other physical goods we sell.
- Platform — the editorial, Open Call, and related online surfaces of perpetuaforma.com.
- Agreement — the contract between you and us for any of the above.
2. Applicability
These terms apply to every offer, Agreement, and delivery between you and us. Any conflicting terms you provide — for example standard purchase conditions — are expressly rejected unless we agree to them in writing. Deviations from these terms only apply if confirmed in writing by us.
3. Offers and Agreements
Offers on the site are non-binding and valid for 14 days unless stated otherwise. An Agreement is formed when you place an order and receive a confirmation, or when you accept a written quotation. Obvious typographical or pricing mistakes don’t bind us. Product images are as accurate as we can make them, but minor variations in colour, texture, or surface finish — especially on raw-material pieces — are inherent to handcrafting and don’t entitle you to refuse delivery.
4. Prices and payment
Prices are in euros. For Consumers they include VAT where applicable; for business customers they’re exclusive of VAT unless stated. Shipping, import duties, and local taxes outside the EU are additional and your responsibility. Consumer orders must be paid in full at checkout via the payment methods offered. Business invoices are payable within 14 days of invoice date; late payment incurs statutory commercial interest.
5. Delivery
We take all reasonable care with order fulfilment. Delivery is to the address you give us, via our logistics partner (Sendcloud, carriers including PostNL, DHL, and DPD). Stated delivery timeframes are indicative: in-stock items typically ship in 2–5 business days, made-to-order items in 5–7 weeks. Full details are in our shipping policy. Risk passes to you at the moment the carrier hands the package to you or your designated recipient.
6. Assembly
Some Products are shipped flat-packed and require assembly. You are responsible for assembling the Product according to the instructions provided. We’re not liable for damage to the Product, other property, or injuries caused by incorrect assembly, unsuitable tools, or deviation from the instructions.
7. Right of withdrawal (Consumers)
As a Consumer you have the right to cancel the Agreement within 14 calendar days of receiving the Product, without reason. During this period please handle the Product and its packaging with care; unpack only enough to assess whether you want to keep it.
The right of withdrawal does not apply to custom, made-to-order, or personalised Products. Full return mechanics — how to request, who pays shipping, refund method and timing — are in the returns & refunds policy.
Business customers don’t have a statutory right of withdrawal for distance purchases.
8. Material character
Several pieces in the PF Collection are made from raw aluminium or similarly unfinished materials. Small extrusion marks, fine scratches, and natural surface variation are inherent to the material and production process — they’re part of the object, not defects. We describe this openly on the relevant product pages.
9. Accounts
You can browse the site without an account. Creating one lets you place orders more easily, subscribe to the newsletter, track pre-orders, submit work, or claim a studio or photographer profile. Keep your password secure; you’re responsible for activity carried out under your account.
You can delete your account any time from /account. When you do: any articles you authored remain on the platform but the author line becomes anonymous, and any studio or photographer profile you’d claimed reverts to unclaimed. Everything else tied to your account (submissions, enquiries, pre-orders, newsletter subscription) is deleted, subject to records we’re legally required to keep (see the privacy policy). Only administrators can delete published articles. We may suspend or terminate accounts that breach these terms or applicable law.
10. Contributor submissions and licence
When you submit a project for editorial publication or an entry for an Open Call, you confirm that you own (or have cleared) the rights to the text and images you’re sharing, including from photographers and collaborators. You retain ownership of your work; you grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce, and promote the work on the platform and in associated publications (including printed Issues).
If a piece is selected through the Open Call, we’ll agree a separate contract covering production, positioning, and terms before the piece enters the collection. This is not handled by these general terms.
11. Warranty and liability
Your statutory rights as a Consumer under Dutch and EU law apply in full. In particular, under article 7:18 of the Dutch Civil Code (Burgerlijk Wetboek) goods must conform to the contract for at least two years from delivery: a non-conforming item can be repaired, replaced, or refunded within that window. For the first six months any non-conformity is presumed to have existed at delivery unless we can show otherwise. Outside those statutory rights, our liability for indirect or consequential damages is excluded to the extent permitted by law. Nothing in these terms limits liability for death, personal injury, or anything else that cannot be limited by law.
12. Complaints
If something isn’t right, email info@perpetuaforma.com with your order number and, where relevant, a photo. We aim to respond within 5 business days. Consumers also have access to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
13. Changes to these terms
We may update these terms as the platform and shop evolve. The Last updated date above reflects the latest version. Material changes are announced in the newsletter or on your next visit.
14. Governing law
These terms are governed by Dutch law. Disputes are subject to the exclusive jurisdiction of the competent court in The Hague, unless another court has exclusive jurisdiction by law.
